This page tells you information about us and the legal terms and conditions (“Terms of Service”) under which we sell any of the products (“Products”) listed on our website, mobile or tablet application (if applicable), or any other platform (collectively referred to as “Site”) to you. All Things Nice Distribution FZ-LLC t/a holster® UAE (also, ‘we’ or ‘us’), a company registered and operated under the laws of the United Arab Emirates, owns and operates this Site with its address citandi et executandi at Compass Building, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates or email: contact@holsterfashion.ae.
holster® UAE is powered by Shopify® and which has their own Legal Terms and Conditions of various subject-matters. You are requested to access, read and understand this here; and which terms and conditions are incorporated herein and which are applicable to you. This too applies to Stripe – see the Payments section below.
By using or accessing this Site, you acknowledge that you have read, understood and agreed to be bound by these and all other referenced and incorporated terms and conditions of use (“Terms of Service”). If you do not agree to the Terms of Service, please do not use this Site.
Terms of Service
These Terms & Conditions apply to your use of the Website. By accessing, browsing, using or registering on our Website, you confirm that you have read, understood and agree to these Terms & Conditions in their entirety. Please check this page regularly to determine whether our Terms & Conditions have been updated - any new terms will automatically be effective when they are published on this Website.
We reserve the right to:

- refuse any user access to our Site;
- terminate user accounts;
- modify or withdraw (temporarily or permanently) this Site without notice; or
- cancel customer orders at our discretion.
Registration
You may register as a customer of the Website and as part of the registration process you will need to select a password which is in accordance with our password policy. You are solely responsible for the security of your password and account. You agree to notify us immediately if you suspect any unauthorised use of your account or access to your password. We would be storing your information to be able to make your experience with our brand better.

holster® UAE owns the Site and, unless otherwise indicated, owns or is licensed to use all content and other material appearing on the Site. The material on this Site is protected by copyright under the laws of Australia and may not be used without written permission by Holster® Pty Ltd, a company incorporated in Australia (“holster®”). No trademark (whether registered or not) that is displayed on this website may be used in any way without the prior written permission of holster® or of the relevant trademark owner.
All copyright, trademarks and other intellectual property rights in all material, content or software supplied as part of our Site, including emails or any other form of communication with you is protected by international copyright and database right laws and shall remain at all times vested in Us or, where relevant, our franchisors/licensors.
You are permitted to use this material only as expressly authorised by us or our franchisors/licensors. You may not extract and/or utilise the whole or any part the Website without our express written consent.
The brand names and logos indicated on our Site and all related emails are owned either by us or by our franchisors/licensors in the territories in which we operate.
We may provide the functionality to allow customers to provide product ratings and reviews (“User Content”) in relation to the products. If so, customers are solely responsible for such User Content, and you warrant that any User Content you post is accurate and that you are the sole author. We do not necessarily review User Content prior to it being posting and it may not reflect our views or opinions. You hereby assign to us all intellectual property rights in any User Content you post on the Site. We make no warranty as to the accuracy or reliability of such User Content. We reserve the right to remove User Content which in our sole opinion is deemed to be incorrect, offensive, illegal or otherwise unacceptable. User Content which provides negative reviews of Products will generally be deemed acceptable when objective, not otherwise in breach of these Terms of Service and posted by a verified customer.
Security
holster® UAE stores your data in electronic form in a secure IT system protected by up-to-date security including firewall, secure access and anti-virus protection. The data is stored on our own, Shopify® data servers and/or on servers operated by highly reputable Cloud / IT system providers with database centres located in centers are held in the United Arab Emirates, Ashburn, Virginia (USA) Frankfurt, Germany. Dublin, Ireland. The computer hardware used, including desktop and laptops, is whole disc encrypted and, in the event of loss, data on devices is capable of being deleted remotely. When replaced, the hard disc of computer equipment is securely destroyed. When email data is to be permanently deleted this is done by instruction to an email archive facility. Please view the Shopify Privacy and Security Compliance Reports and check for updates regularly. Please also view our Privacy Policy.
holster® UAE cannot guarantee any data or program available for access, download or which is used on this Site (or any linked / affiliated / third party website) is free of viruses or other spyware, and you agree that you assume the risk of any damage to your computer and system as a result of using this Site.
Limitation of liability
While we will use reasonable endeavours to verify the accuracy of any information we place on our Site, we make no warranties, whether express or implied in relation to its accuracy or in relation to any transaction that may be conducted on or through the Site, or online storefront, or with customer services (including, but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade).
Although our Site follows high levels of Information Security Standards, we make no warranty that our Site will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the Site or its used server(s) that makes it available are free of viruses or bugs or represents the full functionality, accuracy or reliability of the Site. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Site.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products. Nothing in these Terms of Service shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Revisions
holster® UAE may revise these Terms of Service or the Terms of Purchase below at any time in its absolute discretion by posting revised terms, and these revisions will be effective immediately. If any of the terms are found to be unenforceable, you agree that the remainder of the Terms of Service and the Terms of Purchase remain in full force and effect.
Terms of Product Purchase
The Agreement
In addition to the Terms of Service, these terms and conditions (“the Purchase Terms”) set out the additional terms and conditions under which you may purchase from holster® UAE products appearing on this Site. By completing the customer application process and/or by placing an order for products through our Site, you are confirming that you intend to enter into a contract with us for the purchase of those products and an agreement exists between you and holster® UAE once holster® UAE accepts an order. Each accepted order is a separate agreement.
Your order
You place the order for your Products on the Website by clicking the ‘Confirm Order’ button at the end of the checkout process. During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory must be completed (which includes providing us with a valid phone number email address). We will then send you an email confirming receipt, the details of your order and the delivery costs which will be added to the purchase price (if applicable).
Please note that neither completion of the online checkout process nor our confirmatory email constitute our acceptance of your order. Our acceptance of your order will take place only upon receipt of full payment from you. You can review the orders you have placed and their current status at any time by visiting our Website and clicking on “Log In” at the top of the page followed by selecting “Track Your Order”.
If we cannot supply you with the Products you ordered for whatever reason, we will not process your order and will inform you of this. If you have already paid for the Products we will provide you with a full refund as soon as reasonably possible.
We accept payments online using Visa and MasterCard credit/debit card in AED (or any other agreed currency).
Orders
holster® UAE reserves the right to accept or reject an order for any reason including without limitation, unavailability of product; an error in the price, image or the product description; or error in your order. Orders are deemed received by holster® UAE at the time of successful transmission of the order, and you will thereafter be unable to cancel the order. Orders are deemed accepted by holster® UAE upon holster® UAE dispatching such order within 14 days.
Product Availability
holster® UAE endeavours to ensure products ordered are available for delivery, however, you acknowledge that, in some cases, this is not possible and holster® UAE may need to reject an order you have placed for a product where holster® UAE establishes that it is actually unavailable for delivery. In such cases, holster® UAE will refund in full all amounts you paid in respect of such unavailable product. holster cannot provide rainchecks for products ordered online and, where permitted by law, reserves the right to limit the sale of products to reasonable or normal household quantities.
Payment
You must pay for your products purchased on this website at the time of placing an order. To pay for products, you will be transferred to external sites operated by Stripe. You agree that Stripe is responsible for processing and the security of your payment, and you hereby release holster from any liability in relation to such payment. Variation of Products and Price
holster® UAE may vary the prices on this Site at any time, and prices are subject to change until you have paid for the products in full. Product availability and product prices may vary between retail stores stocking holster® UAE and those found on this Site.
Delivery
Delivery terms including estimated delivery times are contained in holster® UAE’s Delivery Policy, powered by Shopify®, published here – Delivery Policy – and the Delivery Policy is expressly incorporated in these Terms of Service . Risk in the products passes to you upon dispatch of your order, and title passes upon payment for the products in full.
holster® UAE suggests a work address so someone can receive the delivery in person or selection of the signature required option at checkout.
Please be aware that any items shipped internationally may be subject to import duties and taxes applicable to your country or the country to which you’re shipping. You will be responsible for additional charges incurred for customs clearance. holster® UAE has no control over these charges and cannot predict what they may be. Customs policies vary from country to country; holster® UAE recommends you contact your local customs office for further information.
Returns
Return and warranty claims (including for replacement products, refunds or credits) are detailed in holster® UAE Returns & Warranty Policies here. The Returns and Warranty Policies are expressly incorporated in these Terms of Service. Please refer to these policies to determine your entitlement to a return, and the process you need to follow.
Sale items will not be exchanged or refunded if you simply change your mind regarding style, colour or fit.
Current Promotions
Any current promotions shall be subject to specific terms and conditions which provide details of such promotion, qualifying purchase criteria, maximum use, promotion period, exclusions, disqualifications and others.
Generally, however, promotions can be expected to apply automatically at check-out (subject to qualification), minimum and maximums may apply, gift cards will have their own terms and conditions and generally will not be usable in addition to other promotions or other discounts.
holster® UAE will be the promotor and their decision as to persons eligible to participate therein shall be discretionary and final. Your choice to participate in or use any promotion means that you agree to be bound by these terms and that of any promotion. holster® UAE reserves the right to cancel any promotion and at any time, with no notice, and accepts no liability in relation to any such cancellation. holster® UAE is not responsible for any inaccurate or erroneous information supplied, as part of any promotion.
Limitation of Liability
We shall not be liable for any system failure or malfunction of any current promotions and/or discounts, or any consequences thereof. We accept no liability for any loss or damages arising from suspension, variation or termination or in any other way relating to participation of Current Promotions, except for any liability which cannot be excluded by law.
Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of the United Arab Emirates and shall be subject to the exclusive jurisdiction of the courts of Ras Al Khaimah.
We adhere to applicable local dispute resolution regulations by competent authorities for the settlement of potential customer complaints. See ‘Contact Us’ below.
The invalidity or unenforceability of individual contractual provisions shall not affect the validity of the remaining contractual provisions. In such case, the ineffective or unenforceable provision shall be replaced by the parties by an effective or practicable new provision.
